These terms govern your use of SiteAssay, operated by SiteAssay. By creating an account you agree to them.
Your account and workspace
Data in your workspace is yours. It is isolated from every other workspace, and we access it only to operate the service or when you ask us to help with a problem. You are responsible for the security of your credentials and for what the people you invite into your workspace do.
Acceptable use of outreach
This is the part that matters most, because misuse damages other customers' deliverability as well as your own. You agree that you will:
send only to businesses you have a genuine commercial reason to contact, about services you actually provide;
identify yourself and your business honestly in every message;
honour every opt-out immediately, and never re-add a suppressed address through any route;
comply with the law that applies to you and to the recipient: CAN-SPAM, GDPR/PECR, CASL and their equivalents.
You agree that you will not:
use the product to send bulk unsolicited email at volumes that make the approval step meaningless;
circumvent, automate away or bypass the human approval gate;
use audit results to attack, exploit or gain unauthorised access to any system. The scanners are configured to be read-only and using them otherwise is a breach of these terms and, in most jurisdictions, of the law;
resell raw prospect data as a list product, or represent our measurements as your own proprietary technology while removing the methodology.
We may suspend an account that breaches this section, and we will do so without notice where sending reputation or a third party's systems are at risk.
The service and how it may be accessed
The audit engine, its scoring model and the way findings are weighted and presented are ours. Your reports, your prospect data and anything you write are yours; a subscription buys you the right to use the service and to share the reports it produces with your own clients and prospects, not a right to the system that produced them.
You may not:
reverse engineer, decompile or otherwise attempt to derive the scoring model, its category weights or the check catalogue, whether from the product or from the reports it generates;
access the service by any automated means other than an interface we provide for that purpose, or use a script, scraper or headless browser against it;
retrieve reports in bulk, enumerate report links, or systematically collect the findings across reports that were not generated for you;
use the service, or anything derived from measuring it, to build or improve a competing product.
These are enforced with rate limits and account suspension as well as in writing. Automated access at a volume that degrades the service for others may be blocked without notice.
The free audit tool
The public audit tool at /tools/website-audit is offered without an account and without a guarantee of availability. It runs a reduced set of checks against a site's public pages only; it does not sign in anywhere, submit forms or probe for vulnerabilities. Scans are rate limited per network and capped daily, and we may refuse or withdraw access to it at any time. Only scan a site you own or have permission to scan.
Usage, billing and cancellation
Subscriptions are billed in advance through Paddle, which acts as merchant of record. Each plan includes a monthly allowance of searches and audits that resets on renewal and does not roll over; separately purchased top-ups do not expire on renewal. Searches and audits are consumed when the work succeeds, and are not refunded for work you later decide you did not want. Where a plan permits it, usage past the monthly allowance is billed at the overage rate published on the pricing page and appears on your next invoice. You can cancel at any time and keep access until the end of the paid period.
Availability and audit accuracy
We work to keep the service available but do not guarantee uninterrupted operation. Audit findings are automated measurements of a website at a point in time, produced with third-party open-source tooling. They can be wrong, incomplete, or made stale by a change to the site five minutes later. You are responsible for reviewing a report before you send it to anyone, and for any advice you give on the back of it. The service is provided "as is", without warranties beyond those that cannot lawfully be excluded.
Liability
To the extent permitted by law, our aggregate liability arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost business, or indirect or consequential loss.
Changes
We may update these terms; material changes will be announced to account holders by email before they take effect. Continued use after that constitutes acceptance.
